1. Parties & Acceptance

These Terms & Conditions ("Agreement") govern your access to and use of the MyShrine platform ("Platform"), operated by Aquila Global Ltd trading as MyShrine (shrine.io), a company registered in England & Wales ("Company", "we", "us", or "our"). Our registered correspondence address and support contact is support@myshrine.io.

By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by this Agreement in full. If you do not agree to these terms, you must cease use of the Platform immediately.

2. Definitions

In this Agreement, the following terms have the meanings set out below:

• Platform — the MyShrine website, applications, and related services accessible at shrine.io.
• Creator — a verified individual who has completed KYC and uses the Platform to upload and sell Content.
• Fan — an individual who uses the Platform to purchase, access, or interact with Content.
• Content — any digital material (including without limitation video, photographs, audio recordings, text, or other media) uploaded by a Creator to the Platform.
• Services — the features, tools, and functionality provided via the Platform, including content hosting, payment processing, and communication tools.
• Agreement — these Terms & Conditions, together with our Privacy Policy, Refund Policy, and Content Moderation Policy, each incorporated herein by reference.

3. Eligibility

To use the Platform, you must:

• Be at least 18 years of age as verified through our age verification process;
• Be legally permitted to access adult content in your jurisdiction;
• Not be located in any jurisdiction where access to adult content of this nature is prohibited by applicable law;
• Have the legal capacity to enter into a binding agreement; and
• Not have previously been suspended or permanently banned from the Platform.

By using the Platform, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify your eligibility at any time and to suspend or terminate access where we have reason to believe eligibility requirements are not met.

4. Creator Terms

4.1 Verification & KYC

All Creators must complete identity verification ("Know Your Customer" or "KYC") via our third-party verification provider, Didit, prior to activation. Verification requires submission of a valid government-issued photo identification document confirming that the Creator is 18 years of age or older. Accounts will not be activated until verification is successfully completed and approved.

4.2 Content Moderation

All Content uploaded by Creators is subject to mandatory pre-publication review by our moderation team. No Content is published or made publicly visible without receiving moderation approval (status: approved). Creators acknowledge and agree that publication is not guaranteed and that the Company reserves the right to reject any Content at its sole discretion.

4.3 Creator Warranties

By uploading Content to the Platform, each Creator represents and warrants that:

• All persons depicted in the Content were 18 years of age or older at the time of the creation of such Content;
• The Creator has obtained and retains all records required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75 (where applicable) and all equivalent legislation in applicable jurisdictions;
• The Creator holds all necessary rights, licences, consents, and permissions to upload, display, and distribute the Content via the Platform;
• The Content does not infringe any third-party intellectual property, privacy, or other rights; and
• The Content complies with all applicable laws and regulations.

4.4 Prohibited Content

Creators may not upload, distribute, or otherwise make available any Content that:

• Depicts, references, or simulates persons under 18 years of age in a sexual context (CSAM);
• Constitutes non-consensual content or is presented as non-consensual;
• Depicts real violence, gore, or physical harm;
• Depicts bestiality;
• Involves illegal substances or activities;
• Violates any applicable law or regulation in any jurisdiction in which the Platform operates.

Where Content breaches this clause, we will remove the offending Content immediately. For most violations, our three-strike warning system (see Section 9) applies and your account will not be terminated. However, where Content constitutes or is suspected to constitute child sexual abuse material (CSAM), non-consensual intimate imagery (NCII), or any other material that we are legally required to report or act upon under applicable law, we are obliged to take immediate action including account suspension and referral to law enforcement and/or the Internet Watch Foundation (IWF). Such action is not discretionary but a legal obligation under UK law.

4.5 Creator Status

Creators are independent contractors and not employees, agents, or partners of Aquila Global Ltd. Nothing in this Agreement shall be construed to create any employment relationship, partnership, joint venture, or agency between a Creator and Aquila Global Ltd.

4.6 Earnings & Platform Fee

Creators receive net earnings after deduction of a platform fee of 5% of the fan payment amount. The platform fee is deducted at the point of confirmed sale and is not deducted at the point of withdrawal. Net earnings are paid out to the Creator's designated cryptocurrency wallet in accordance with our payout schedule.

5. Fan Terms

5.1 Purchases & Digital Content

Fans purchase a personal, non-transferable, non-exclusive licence to access specific digital Content. All sales of digital Content are final once access has been granted or the Content has been downloaded. Please review our Refund Policy for full details.

5.2 Permitted Use

Purchased Content is licensed for personal, private use only. Fans may not redistribute, share, resell, sublicence, copy, or otherwise disseminate purchased Content to any third party, whether for commercial gain or otherwise. Unauthorised distribution of Content may constitute copyright infringement and/or breach of contract and may result in legal action.

5.3 Age Verification

Age verification via Didit biometric verification is required at account creation. By completing age verification, you confirm that you are 18 years of age or older.

5.4 Tributes & Gifts

Fans may send voluntary monetary tributes and gifts to Creators natively on the Platform. Tributes and gifts are voluntary payments and are non-refundable. See our Refund Policy for further details.

6. Prohibited Conduct

All users (Creators and Fans) are prohibited from:

• Uploading, sharing, or distributing any Content involving persons under 18 years of age;
• Uploading, sharing, or distributing non-consensual content or content presented as non-consensual;
• Uploading, sharing, or distributing Content depicting real violence or gore;
• Uploading, sharing, or distributing content depicting bestiality;
• Uploading, sharing, or distributing Content that violates any applicable law;
• Harassing, threatening, or abusing other users of the Platform;
• Engaging in fraudulent payment activity;
• Attempting to circumvent age verification or identity verification systems;
• Scraping, harvesting, or systematically extracting data from the Platform;
• Attempting to reverse-engineer, decompile, or otherwise tamper with the Platform.

7. Payment Terms

All payments on the Platform are processed via NOWPayments (cryptocurrency) in Phase 1 of the Platform's operation. Prices are displayed in GBP; the cryptocurrency equivalent is calculated at the prevailing rate at the time of payment.

The billing descriptor on all transactions will appear as AQUILA GLOBAL LTD. If you do not recognise a charge under this descriptor, please contact support@myshrine.io before initiating a chargeback.

A platform fee of 5% is deducted from the fan payment amount at the point of sale before allocation of net earnings to the Creator.

8. Intellectual Property

Creators retain full ownership of all Content they upload to the Platform. By uploading Content, each Creator grants Aquila Global Ltd a worldwide, non-exclusive, royalty-free, limited licence to host, store, display, transmit, and make available the Content on and via the Platform solely for the purposes of operating the Services.

Fans who purchase Content receive a personal, non-transferable, non-exclusive licence to access and view the purchased Content for personal private use only. No ownership rights in the Content are transferred to Fans.

All trade marks, logos, and other intellectual property relating to the MyShrine brand and Platform are owned by Aquila Global Ltd and may not be used without prior written consent.

9. Account Enforcement & Warning System

9.1 Our Approach — Content Removal, Not Account Removal

We believe in supporting creators for the long term. Our policy is to remove non-compliant Content rather than remove accounts. If your Content breaches our policies, we will take down the specific Content in question and issue a formal warning. Your account will not be suspended or terminated as a first or second response to a content policy breach.

9.2 Three-Strike Warning System

Where a Creator uploads Content that breaches our Content Policy (Section 4.4) or community guidelines, the following process applies:

Warnings are issued in writing to the email address associated with your account. You have the right to appeal any warning or deactivation decision by contacting support@myshrine.io within 14 days of the notice.

9.3 Mandatory Legal Exceptions

The three-strike system does not apply in circumstances where we are subject to a legal obligation to act immediately. We are required by law to take immediate action — including account suspension and referral to law enforcement — in the following circumstances:

• Content that constitutes or is suspected to constitute child sexual abuse material (CSAM) — we are legally obligated to report to the Internet Watch Foundation (IWF) and relevant law enforcement agencies;
• Non-consensual intimate imagery (NCII), commonly known as "revenge pornography", where we receive a valid takedown request or identify such material;
• Content that is the subject of a court order, statutory notice, or a formal request from law enforcement or a regulatory authority with appropriate jurisdiction;
• Fraudulent activity involving payment systems or identity fraud that exposes the Platform or its users to financial or legal risk.

In these specific circumstances only, immediate suspension is a legal obligation and not a discretionary enforcement decision. Creators who breach these specific categories forfeit any pending earnings attributed to or arising from the violating Content.

9.4 Account Closure by User

Users may request closure of their account at any time by contacting support@myshrine.io. Account closure is subject to resolution of any outstanding transactions or obligations.

10. Limitation of Liability

MyShrine operates as a platform and technology intermediary. We are not the publisher, producer, or author of Creator Content. To the fullest extent permitted by applicable law:

• Our total aggregate liability to you in connection with this Agreement shall not exceed the total amount paid by you to us in the twelve (12) months immediately preceding the event giving rise to the claim;
• We shall not be liable for any indirect, consequential, incidental, special, exemplary, or punitive damages, including loss of profits, loss of data, or loss of goodwill, arising out of or in connection with your use of or inability to use the Platform;
• We shall not be liable for the Content, actions, or omissions of Creators or Fans on the Platform.

Nothing in this Agreement excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.

11. Governing Law & Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of England & Wales. The courts of England & Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement, subject to the following:

• EU users: Mandatory statutory protections afforded to consumers under applicable EU consumer law are not excluded by this Agreement. EU consumers may bring proceedings in the courts of their country of residence.
• US users: Disputes between US users and Aquila Global Ltd shall be subject to binding individual arbitration in accordance with the rules of the American Arbitration Association (AAA), except that either party may seek emergency equitable relief in a court of competent jurisdiction. Class action waivers apply to the fullest extent permitted by law.

12. Changes to These Terms

We reserve the right to amend these Terms & Conditions at any time. Material changes will be communicated to registered users via email at least 14 days before they take effect. Your continued use of the Platform following the effective date of any revised terms constitutes your acceptance of those changes.

We recommend reviewing these terms periodically. The "Last updated" date at the top of this page indicates when these terms were most recently revised.
