DMCA & Copyright Policy

1. Our Commitment to Copyright

Aquila Global Ltd trading as MyShrine respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA) (17 U.S.C. § 512) and the EU Copyright Directive (Directive 2019/790/EU). For UK users, this policy also applies under the Copyright, Designs and Patents Act 1988.

If you believe that content appearing on the Platform infringes your copyright, please follow the procedure set out in this policy. We will respond to valid notices promptly and take appropriate action.

2. Reporting Copyright Infringement — DMCA Takedown Notice

To submit a DMCA takedown notice, send your notice to our Designated Copyright Agent:

Required Information

Your DMCA notice must include all of the following, pursuant to 17 U.S.C. § 512(c)(3):

1. Your full legal name, mailing address, telephone number, and email address;
2. A description of the copyrighted work that you claim has been infringed, or, if multiple works are covered, a representative list of such works;
3. The URL or sufficiently specific description of the location of the allegedly infringing material on shrine.io to enable us to identify and locate the material;
4. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or applicable law;
5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on behalf of the copyright owner; and
6. Your physical or electronic signature.

Incomplete or deficient notices may not be processed. We will acknowledge receipt of your notice within 72 hours and will remove or disable access to confirmed infringing content promptly following verification.

3. Counter-Notice Procedure

If you believe that content you uploaded was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice to our Designated Copyright Agent at support@myshrine.io with the subject line "DMCA Counter-Notice".

Required Information for Counter-Notice

Your counter-notice must include, pursuant to 17 U.S.C. § 512(g)(3):

1. Your full legal name, mailing address, telephone number, and email address;
2. Identification of the material that has been removed or disabled, and the location at which the material appeared on shrine.io before it was removed or disabled;
3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
4. A statement that you consent to the jurisdiction of:
   • The Federal District Court for the judicial district in which your address is located (US users); or
   • The courts of England & Wales (UK and EU users);
   and that you will accept service of process from the person who submitted the original DMCA notice or their agent; and
5. Your physical or electronic signature.

Upon receipt of a valid counter-notice, we will forward a copy to the original complainant and may restore the removed content after 10–14 business days, unless the complainant notifies us that they have sought a court order to restrain the allegedly infringing activity.

4. Repeat Infringer Policy

In appropriate circumstances, and at our sole discretion, we will terminate the accounts of users who are determined to be repeat infringers. A "repeat infringer" is a user who has been subject to more than one valid DMCA takedown notice in respect of content they have uploaded to the Platform.

5. UK & EU Copyright

For users in the United Kingdom, this policy also applies under the Copyright, Designs and Patents Act 1988 (CDPA). Rights holders in the UK may also contact us using the same procedure set out above to report infringement of rights protected under UK copyright law.

For users in the European Union, this policy applies under the EU Copyright Directive (Directive 2019/790/EU). EU rights holders may use the same procedure set out above to report infringement. In accordance with Article 17 of the EU Copyright Directive, we maintain appropriate content moderation processes to prevent the availability of infringing content.

6. Misrepresentation Warning

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be subject to liability for any damages incurred, including costs and attorneys' fees. Please ensure that the information contained in your notice or counter-notice is accurate before submitting.
